Terms & Conditions

Welcome to CHO. These Terms & Conditions ("Terms") govern your use of the CHO mobile app and related services, operated by Come Hang Out Ltd ("CHO", "we", "us", or "our"), a company registered in New Zealand.

By creating an account or using CHO, you agree to these Terms. If you don't agree with them, please don't use CHO.

1. Who can use CHO

You must be 18 years or older to create an account or use CHO.

By signing up, you confirm that the information you provide, including your date of birth, is accurate and up to date.

You are responsible for keeping your account secure and for everything that happens through your account. You must not create an account for someone else without their permission or deliberately provide false information about who you are.

Unless we allow otherwise, you may only maintain one CHO account.

2. What CHO is for

CHO helps people create and join real-world hangouts and events with other people.

It's designed for meeting new people, making friends, and getting out and doing things together.

CHO isn't designed primarily for dating, business advertising, or activities that aren't consistent with these Terms or our Community Guidelines.

Our Community Guidelines form part of these Terms and explain the behaviour we expect from everyone using CHO.

3. Events are created by users

Events on CHO are generally created and organised by CHO users, not by CHO itself.

Unless we explicitly say otherwise, CHO does not organise, supervise, sponsor, endorse, or guarantee an event or its host.

Event hosts are responsible for providing accurate information about their events and choosing appropriate locations and activities. Hosts must also follow these Terms, our Community Guidelines, and any laws that apply to their event.

We may remove or modify an event if we believe it violates these Terms, our Community Guidelines, creates a safety concern, contains misleading information, or otherwise isn't appropriate for CHO.

4. Meeting people in person

CHO connects you with other users, but what happens when you meet in person is ultimately between you and them.

We provide tools intended to help you make safer choices, including age and gender restrictions that hosts can set, ratings and reporting, blocking, and the ability to leave events.

However, we don't run background checks on users and we don't guarantee the identity, character, intentions, qualifications, or conduct of anyone you meet through CHO.

When attending an event, use your own judgement. Consider meeting in public places, letting someone you trust know where you're going, arranging your own transport, and leaving if you feel uncomfortable or unsafe.

Don't rely on CHO, another user, or an event listing as a guarantee that an event or person is safe.

If you believe you or someone else is in immediate danger, contact the appropriate emergency services rather than relying on CHO.

To the fullest extent permitted by law, CHO is not responsible for injury, loss, damage, dispute, or other harm arising from interactions or meetings between users.

Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited under applicable law.

5. Your content

You keep ownership of the content you post on CHO, including your photos, event descriptions, messages, and other material ("Your Content").

By posting Your Content, you give CHO a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, transmit, resize, format, and otherwise use Your Content as reasonably necessary to provide, operate, maintain, improve, and promote CHO.

For example, this allows us to store your event photo and display it to other users who are viewing that event.

This licence ends when you delete Your Content or your account, except where we need to retain or continue using it for legitimate purposes such as legal obligations, security, fraud prevention, dispute resolution, backups, or enforcement of these Terms.

You are responsible for the content you post. You must have the necessary rights and permissions to post it.

6. Things you must not do

CHO works best when people treat each other with respect.

You must not use CHO to:

This isn't an exhaustive list. We may take action against behaviour that we reasonably believe goes against the purpose or safety of CHO.

7. Reports, moderation, and account restrictions

We want CHO to be a place where people can feel comfortable meeting others.

Users can report events and other members through the app. Reports may be reviewed by our systems or by us and may be used when deciding whether action should be taken.

Our moderation systems may consider factors such as the nature and number of reports and the reliability or standing of the people making those reports.

Some actions may happen automatically. For example, an event may be removed or an account may temporarily lose the ability to create or join events when a predefined threshold is reached.

Automated action isn't necessarily final. We may review, reverse, or modify a restriction where appropriate.

We may also take action based on information other than user reports.

Depending on the circumstances, we may:

Where appropriate, you may contact us through CHO Support to ask for a review of a restriction or moderation decision.

8. Account termination

You can stop using CHO at any time.

We may suspend, restrict, or permanently terminate your account if we reasonably believe that you have:

If your account is terminated, you must not create another account to get around the restriction unless we give you permission to do so.

9. Deleting your account

You can request deletion of your CHO account from within the app.

When your account is deleted, your profile and associated content will be deleted or anonymised where reasonably possible.

Some information may need to be retained for a period of time where we are legally required or permitted to keep it, or where it is reasonably necessary for purposes such as security, fraud prevention, dispute resolution, enforcing our Terms, or maintaining backups.

Account deletion is permanent once completed and cannot normally be undone.

Deleting your account does not necessarily remove information that other users may have independently copied, saved, or shared outside CHO.

10. Ratings and community feedback

CHO may allow users to rate or provide feedback about events and other users.

Ratings and feedback should be honest and based on genuine experiences.

You must not manipulate ratings, create fake reviews, encourage coordinated false reports, or use the rating system to harass or retaliate against another user.

We may remove ratings, reviews, or other feedback that we believe are fake, abusive, misleading, or otherwise inconsistent with these Terms.

11. Third-party services

CHO may rely on third-party services to provide parts of the app, such as hosting, maps, authentication, analytics, notifications, payments, or other functionality.

These services may have their own terms and privacy policies. Your use of those services may therefore also be subject to the relevant third party's terms.

We don't control third-party services and can't guarantee that they will always be available or operate without errors.

12. App stores

If you download CHO through an app store such as Apple's App Store or Google Play, your use of that store is also subject to the store's terms and policies.

These Terms are between you and Come Hang Out Ltd, not between you and the relevant app store.

13. Availability of CHO

We work to keep CHO available and reliable, but we can't promise that it will always be available, uninterrupted, secure, or error-free.

We may change, suspend, or discontinue parts of CHO from time to time, including for maintenance, security, technical, legal, or business reasons.

14. Information provided by users

CHO contains information created by users. We don't guarantee that event descriptions, profiles, messages, ratings, photos, locations, or other user-provided information are accurate, complete, or reliable.

You should use your own judgement when relying on information provided by another user.

15. No warranty

CHO is provided "as is" and "as available."

To the fullest extent permitted by law, we don't guarantee that:

Nothing in these Terms limits rights or guarantees you have under applicable New Zealand law that cannot legally be excluded.

16. Changes to CHO

CHO will change over time. We may add, remove, or modify features, services, or functionality.

We may also update these Terms from time to time.

If we make a meaningful change, we'll update the "Last updated" date at the top of this page and, where appropriate, provide additional notice through the app.

Your continued use of CHO after updated Terms take effect means you accept the updated Terms.

If you don't agree with the updated Terms, you should stop using CHO and delete your account.

17. Intellectual property

The CHO app, including its name, branding, logos, software, design, and original content provided by us, belongs to Come Hang Out Ltd or our licensors.

You may use CHO only for its intended purpose and in accordance with these Terms.

You must not copy, modify, distribute, sell, reverse engineer, or attempt to extract or reproduce substantial parts of CHO unless permitted by law or with our written permission.

18. Privacy

Our Privacy Policy explains what personal information we collect, how we use it, who we may share it with, and how you can exercise your privacy rights.

The Privacy Policy forms part of your agreement with us when you use CHO.

19. Indemnity

To the extent permitted by law, you agree to be responsible for losses, claims, costs, or reasonable expenses that CHO suffers as a result of your serious breach of these Terms, unlawful use of CHO, or infringement of another person's rights.

This section does not apply to the extent that the relevant loss was caused by CHO's own negligence, unlawful conduct, or anything else that cannot legally be excluded.

20. Governing law

These Terms are governed by the laws of New Zealand.

Any disputes relating to these Terms or your use of CHO will be dealt with under the applicable laws and courts of New Zealand, subject to any rights you may have under applicable law.

21. If part of these Terms doesn't apply

If any part of these Terms is found to be invalid or unenforceable, the remaining parts will continue to apply.

If we don't immediately enforce a particular part of these Terms, that doesn't mean we have permanently waived our right to enforce it later.
